Sir,
I have the honour to refer to your despatch
No.166 of the 2nd May, 1933, on the subject of the export
from the United Kingdom to China of Aircraft and aero-
nautical accessories and to forward for your consideration
a copy of a letter written by Air Marshal Sir John Higgins
on behalf of the Far-East Aviation Co., Ltd. to Sir Thomas
Southorn. The original of this letter, being addressed
to Sir Thomas Southorn personally, is believed to have
been forwarded to him in England whither he has proceeded
on leave.

The letter appears to imply that the conditions
precedent required by the Board of Trade to be fulfilled
in respect of the export of arms to China, namely the
prior approval of the Central Government of China are also
required to be fulfilled in the case of export to Hong Kong.
This position would be at variance with the following
passage from the letter (C.R.T. 3711/31) of the 16th
September, 1932, from the Commercial Relations and Treaties
Department of the Board of Trade to the Colonial Office,
a copy of which was enclosed in your Confidential despatch
of the 24th October, 1932
